These Terms & Conditions ("Terms") govern your access to and use of the LocalStalls platform ("Platform") provided by Micah Group Pty Ltd ("Company"). By accessing or using the Platform, you agree to be bound by these Terms.
The Platform assists event organisers in managing their events, clients, stall bookings, and payments. It streamlines operations and enhances event management capabilities.
Access to the Platform is provided on a subscription basis. Event organisers must pay the applicable subscription fees based on the selected pricing plan. Fees may vary based on the features and resources provided.
a. Usage Rights: Event organisers are granted a limited, non-exclusive, and non-transferable right to access and use the Platform during the subscription period.
b. Communication Standards: Event organisers agree that any messaging or communications initiated via the Platform must be free of profanity and spam.
c. Client Contact: When an event organiser’s client is onboarded onto the Platform, they will be prompted to register with LocalStalls. Upon successful registration, the client becomes a LocalStalls user. LocalStalls has the right to contact users directly for promotional purposes via email, SMS, and push notifications. Users may opt out of marketing communications but will still receive transactional or service-related messages.
a. Data Security: The Company is committed to maintaining the security and confidentiality of data provided by event organisers. All reasonable measures will be taken to prevent unauthorised access, use, or disclosure.
b. Data Usage: The Company may collect, process, and use data provided by event organisers to improve the Platform, provide customer support, and comply with legal obligations. Data processing complies with the Australian Privacy Act 1988, UK GDPR, and EU GDPR.
c. International Data Transfers: User data may be stored in or transferred to jurisdictions outside their home country, including the UK, EU, or Australia, in compliance with applicable data protection laws.
a. Ownership: All intellectual property rights related to the Platform, including but not limited to copyrights, trademarks, and patents, belong to the Company.
b. License: Event organisers are granted a limited license to use the Platform solely for the purposes outlined in these Terms. No rights are granted for sublicensing, modifying, or distributing the Platform.
The Company shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Platform, including but not limited to loss of revenue, profits, or data.
The Company reserves the right to suspend or terminate access to the Platform for violations of these Terms or non-payment of subscription fees. Upon termination, event organisers must cease all use of the Platform.
The Company reserves the right to amend these Terms at any time. Users will be notified of changes, and continued use of the Platform constitutes acceptance of the modified Terms.
These Terms are governed by the laws of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts in Victoria, Australia.
